Terms of Service

1. The service

These Terms govern your access to Sea True and its underwater photo-enhancement service. By using Sea True, creating an account, uploading photos or buying a batch, you agree to them.

Sea True automatically adjusts color, clarity and contrast in JPEG underwater photos. A batch may contain between 1 and 500 photos. Results vary with lighting, depth, water conditions, camera settings and the quality of the original file. Sea True is an automated creative tool, so a particular artistic result is not guaranteed.

You must be legally able to enter into a contract where you live. If you use Sea True for an organisation, you confirm that you have authority to bind it to these Terms.

2. Accounts and access

Sea True uses passwordless email links. You must provide an email address you control and keep access to your email secure. Login links are personal, expire quickly and must not be shared.

You are responsible for activity under your account. Tell us promptly if you believe somebody has accessed it without permission. We may refuse or restrict access where reasonably necessary to protect users, the service or the law.

3. Your photos

You keep all ownership rights in your photos. You grant Sea True a limited, worldwide permission to host, copy, transform and deliver the files solely to operate, secure and improve the service for you. This permission ends when the relevant files are deleted, except for limited backups that expire in the ordinary course.

You confirm that you own each upload or have the permission needed to use it. Do not upload unlawful material, images that infringe another person’s rights, malware, or content you do not have the right to process.

Download and keep the results you want. Sea True is a processing service, not a permanent photo archive, and should not be your only copy of any photo.

4. Preview, price and payment

Eligible first-time customers can see up to five enhanced photos free. Preview eligibility is limited per account and browser. If a batch has five photos or fewer and the free preview is available, the complete batch may be processed free.

Sea True automatically selects the smallest plan that fits your uploaded batch: S (up to 100 photos) is €2.99, M (up to 200) is €2.99, L (up to 300) is €3.99, XL (up to 400) is €4.99, and XXL (up to 500) is €5.99. The final checkout shows the amount and any applicable tax before you pay. Payment unlocks processing of the remainder of that specific batch and does not renew.

Our order process is conducted by our authorised reseller, Paddle.com. Paddle is the merchant of record for purchases, collects payment and applicable taxes, issues receipts, and handles payment support and refunds. Your purchase is also subject to Paddle’s Buyer Terms and our Refund Policy.

Processing may begin immediately after payment. If you are asked at checkout to consent to immediate performance, that choice may affect a statutory withdrawal right as explained in the Refund Policy.

5. Acceptable use

You may not misuse Sea True or help anybody else do so. In particular, you must not:

• probe, disrupt, overload or bypass the service’s security or usage limits;
• use automated means to scrape the service or create accounts at scale;
• attempt to obtain repeated free previews by deceptive means;
• reverse engineer the service except where the law expressly permits it; or
• use Sea True in a way that harms another person or breaks applicable law.

6. Availability and changes

We work to keep Sea True reliable, but uploads, processing and downloads can occasionally be delayed or interrupted. We may maintain, change or discontinue features. If a material service failure prevents a paid batch from being delivered, the remedies in the Refund Policy apply.

Sea True owns the service, its software, design, brand and documentation. These Terms give you a limited, non-exclusive right to use the service; they do not transfer Sea True’s intellectual property to you.

7. Warranties and responsibility

Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded. If you are a consumer, you keep all mandatory consumer protections that apply where you live.

To the extent permitted by law, Sea True is provided without promises that it will be uninterrupted, error-free or suitable for a particular professional purpose. Sea True is not responsible for losses caused by your failure to keep backup copies, unsupported or corrupted files, events outside our reasonable control, or uses that breach these Terms.

For business users, Sea True is not liable for indirect loss, loss of profit, revenue, opportunity, goodwill or data. To the extent permitted by law, Sea True’s total liability connected with a paid batch will not exceed the amount paid for that batch. These limits do not apply where liability cannot legally be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence.

8. Ending use and changes to these Terms

You may stop using Sea True at any time. We may suspend or end access for a material breach, fraud, security risk or legal requirement. Where practical, we will give notice and a chance to correct the issue.

We may update these Terms as the service or law changes. The date above identifies the current version. Material changes will apply prospectively, and we will provide reasonable notice where required. If any provision is unenforceable, the remaining provisions continue to apply.

These Terms are governed by the laws applicable where the Sea True operator is established, without depriving consumers of mandatory protections or access to courts available in their home country.
